Terms of Use
In these Terms and Conditions, the following terms are defined as follows:
- Account refers to the account or profile that You register on the Platform, whether verified or unverified, to access the products, facilities, and/or Features of the Platform.
- Application means an application owned by the foundation with name of “Trees4tree” or any other name to be used by You, which will be available and can be downloaded on the Google Play Store and/or App Store, which will be managed by the foundation.
- Foundation (referred to as either “the Foundation”, “We”, “Us” or “Our” in this Agreement) refers to Bumi Hijau Lestari Foundation.
- Country refers to Republic of Indonesia.
- Device means any device that can access the Service such as a computer, a cell phone or a digital tablet.
- Feature refers to services, features, and/or products, both existing and developed from time to time.
- Platform refers to the Website and the Application.
- Service refers to the services provided through the Website and/or Application.
- Terms and Conditions (also referred as “Terms”) mean these Terms and Conditions that form the entire agreement between You and the foundation regarding the use of the Service.
- Third-party Social Media Service means any services or content (including data, information, products or services) provided by a third-party that may be displayed, included or made available by the Service.
- Website refers to Trees4trees, accessible from https://Trees4trees.org/, as well as any other website owned or shall be owned by the foundation, including under other domains or sub-domains that shall be developed and operated by the foundation in the future.
- You means the individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.
Acknowledgment
These are the Terms and Conditions governing the use of this Service and the agreement that operates between You and the foundation. These Terms and Conditions set out the rights and obligations of all users regarding the use of the Service.
Your access to and use of the Service is conditioned on Your acceptance of and compliance with these Terms and Conditions. These Terms and Conditions apply to all visitors, users and others who access or use the Service.
By accessing or using the Service You agree to be bound by these Terms and Conditions. If You disagree with any part of these Terms and Conditions, then You may not access the Service. If You do not agree to be bound with this Terms and Conditions, You may not access or use any part of the Service. These terms contemplated herein constitute a binding legal agreement between You as an individual user and the foundation.
You represent that you are at least 18 years old if you make a donation or complete any payment transaction through the Service. In accordance with Indonesian regulations, individuals under 18 are not permitted to make donations or engage in financial transactions on the platform, but may access the website and participate in campaigns where permitted.
Your access to and use of the Service is also conditioned on Your acceptance of and compliance with the Privacy Policy of the foundation. Our Privacy Policy describes Our policies and procedures on the collection, use and disclosure of Your personal information when You use the Application or the Website and tells You about Your privacy rights and how the law protects You. Please read Our Privacy Policy carefully before using Our Service, which can be accessed through the following:
User Account
By creating an Account or using the Service, You represent and warrant that You have the legal capacity to enter into a binding agreement under the laws of Your jurisdiction.
If You are an individual:
- You must be at least 18 (eighteen) years old to make donations or conduct any payment transactions through the Platform.
- Individuals under 18 years old may access the Platform and participate in campaigns where permitted, but are strictly prohibited from making donations or engaging in financial transactions.
If You are acting on behalf of a legal entity, You represent that the entity is duly established under applicable law and that You are duly authorized to bind such entity to these Terms, including having obtained any required internal approvals.
Registration of an Account is free of charge, unless otherwise specified in separate agreements. Each Account must be registered using a unique email address and mobile phone number. An entity may register multiple Accounts, provided each Account uses different credentials.
To access certain features, You must create an Account and provide accurate, complete, and up-to-date information. We may request supporting identification where necessary. All personal data will be processed in accordance with Our Privacy Policy.
You are solely responsible for maintaining the confidentiality and security of Your Account credentials. You may not share, transfer, or sell Your Account without Our prior written consent. Any activity conducted through Your Account shall be deemed Your responsibility. The Foundation shall not be liable for losses arising from unauthorized use resulting from Your negligence.
We reserve the right, at Our sole discretion, to suspend, restrict, deactivate, or delete Your Account in the event of:
- violation of these Terms;
- suspected unlawful activity; or
- any suspicious or harmful conduct affecting the Platform or other users.
We may send administrative notifications related to Your Account. Any processing of personal data, including contact information, shall be governed by Our Privacy Policy.
Services
Through the Platform, We provide the following Services:
Planting trees
We may modify, delete, and/or add Services within the Platform in accordance with Our internal policies, as well as changes in the applicable laws and regulations in the Country.
For Services ordered by You, We may impose fees determined by Us to be paid by or charged to You to use such Services. The Service fees displayed on the Platform are the prices set by the foundation.
By completing a transaction through the Platform, You agree to pay the total amount displayed on the payment page. The Foundation reserves the right to modify the fees for its Services at its discretion. The amount displayed at checkout shall be deemed final and binding for that transaction.
Transactions
You are required to transact through the transaction procedures set by the foundation.
You fully understand and agrees that all transactions made by You, other than the procedures that have been set, are Your responsibility.
You are highly recommended to keep the proof of payment provided for any transactions made on the Platform.
You understand and agrees that the problem of delays in the payment process and additional costs caused by differences in the bank that You use with the foundation’s authorized bank Account is Your personal responsibility.
Payment Procedure
All payments are calculated and settled in Indonesian Rupiah (IDR). If you pay using another currency, the amount will be converted to IDR based on the exchange rate at the time of the transaction.
The foundation reserves the right to collect taxes or levies if required or regulated by applicable laws and regulations. However, if the foundation does not determine or instruct, You (or other parties, if any) will bear their own tax and retribution payments by themselves.
Payment methods include but are not limited to bank transfer, and other payment methods available on the Platform (including any third-party payment method that under cooperation with the foundation).
For payment by bank transfer, You must provide a bank transfer receipt as proof of payment for the reservation listed in the foundation’s confirmation email. You must follow the procedures contained in the confirmation email.
For all transactions made, You must make the payment within the specified time limit. If payment is not made, the foundation reserves the right to cancel the transaction.
All transactions are final once processed, subject to the Cancellation and Refund provisions set out in these Terms.
The foundation collaborates with third parties who are licensed Payment Service Providers (PSP) by Bank Indonesia, including but not limited to payment gateway features for purchases through the Platform. By using these payment services, You are also deemed to agree to any additional terms and conditions (if any) from these third parties as the providers of such services.
In the event of any issues with the payment gateway feature from Your end, You will be subject to the terms stated in the Terms and Conditions, and You will fully release and discharge the foundation from any claims, demands, damages, and/or other liabilities related to such matters.
Cancellation and Refund
Donations are voluntary and non-cancellable once processed. A refund request may be submitted within 10 (ten) calendar days from the donation date, provided the donation has not been allocated or utilized.
Refund requests must be submitted in writing and are subject to verification and approval at the Foundation’s discretion. Refunds will not be granted after the 10-day period, for donations already allocated, or in cases of misuse or fraudulent conduct.
Approved refunds will be processed through the original payment method. Applicable banking fees, currency differences, or third-party charges may be deducted. Failed or duplicate transactions will be fully refunded.
Ownership of the trees
By making a donation, you are supporting tree planting activities, including when the tree is given as a gift. However, your donation does not give you ownership rights to the tree or the land where it is planted.
The planted tree is the legal property of the owner of the land where the tree is located.
As a donor, you have the personal right to state that you have planted or contributed to the planting of the tree. This right is solely for recognition purposes and cannot be transferred to another party. This right does not grant ownership or any legal rights to the tree or the land.
User Rights and General Prohibitions
The foundation grants You a personal, worldwide, royalty-free, non-transferable, non-exclusive, revocable, and non-sublicensable license to access and use the Services. This license is for the sole purpose of enabling You to use and enjoy the benefits of this Service as intended by the foundation and permitted by this Terms and Conditions.
When accessing the Platform and/or using the Service, You are prohibited from:
- intentionally and without right or unlawfully intercepting or eavesdropping on the transmission of electronic information and/or electronic documents or electronic information and/or electronic documents belonging to other users or the foundation;
- intentionally and without right or unlawfully altering, adding, reducing, transmitting, damaging, deleting, moving, or hiding any electronic information and/or electronic documents listed on the Platform, whether private or public;
- intentionally and without right or unlawfully taking any action resulting in the disruption of other users’ access to the Platform;
- intentionally and without right or unlawfully sublicensing, producing, selling, arranging for use by others, distributing, providing, or acknowledging ownership of the Platform, Features, or other intellectual property rights owned by the foundation;
- intentionally and without right or unlawfully manipulating, changing, deleting, partially or wholly destroying the Platform;
- exploiting the Platform and/or the Features to conduct transactions involving fraud or violations of third-party rights and violate applicable laws in the Country;
- using programs or performing activities to access, search, or obtain information that is not Your right from the Platform;
- disrupting or damaging servers or networks connected to the Platform or disregarding standard procedures, rules, or laws applicable in the Country regarding internet connections;
- attempting to access parts of the Platform that You are not authorized to access;
- engaging in plagiarism or publishing content or materials displayed on the Platform without permission from the foundation or related third parties or without identifying the foundation or related third parties as the copyright holder of the content or materials;
- engaging in or attempting to reverse engineer, decompile, dismantle the programming code or algorithms or structure contained in the Platform; and/or
- engaging in, instructing, participating, assisting, or providing opportunities to engage in activities that violate applicable laws in the Country, violate these Terms and Conditions, infringe on third-party rights, or act in bad faith while accessing the Platform.
The foundation reserves the right to seek damages, file civil suits, or initiate criminal proceedings for all prohibited acts as referred to in this point as well as these Terms and Conditions as a whole.
Intellectual Property Rights
We are the licensee rights to the ‘Trees4trees’ name, icon and logo, which are copyrights and trademarks protected by the laws of the Country. You may not use, modify, or install the name, icon, logo, or brand without written consent from the foundation.
We may take legal action against any violations committed by You related to intellectual property rights.
Links to Other Websites
Our Service may contain links to third-party web sites or services that are not owned or controlled by the foundation.
The foundation has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party web sites or services. You further acknowledge and agree that the foundation shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods or services available on or through any such web sites or services.
We strongly advise You to read the terms and conditions and privacy policies of any third-party web sites or services that You visit.
Privacy Policy
You are required to read Our Privacy Policy carefully when using the Platform, which explains the use of data and Our privacy policy implementation. You are expected not to submit any personal data and/or any data without first reading Our Privacy Policy.
We will always safeguard Your personal data in accordance with these Terms and Conditions, the Privacy Policy, and the applicable laws of the Country. Further provisions regarding the security of Your personal data can be accessed through Our Privacy Policy, which is an integral part of these Terms and Conditions.
Term
These Terms and Conditions shall remain in effect indefinitely and shall continue to bind You for as long as You use the Platform until terminated for reasons specified in the Terms and Conditions.
Termination
We may terminate, restrict, or suspend Your access immediately, without prior notice or liability, for any reason whatsoever, including without limitation in the event of any violation committed by You against all or part of Terms and Conditions, failure to fulfil Your obligations to Us, and/or any alleged violation or breach of law committed by You that may directly or indirectly harm Us.
Temporary suspension, restriction, or termination of Your access to the Platform, Features, and/or Your Account, whether temporary or permanent, does not limit Us from seeking damages, reporting to authorities, and/or taking any other actions We deem necessary to protect the interests of the foundation.
Upon termination, Your right to use the Service will cease immediately.
Disclaimer of Warranties
The Service is provided on an “AS IS” and “AS AVAILABLE” basis, with all faults and without warranties of any kind. To the fullest extent permitted by applicable law, the Foundation, including its affiliates, licensors, and service providers, expressly disclaims all warranties, whether express, implied, or statutory, including but not limited to warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
The Foundation does not warrant that the Service will meet Your requirements, achieve any intended results, operate uninterrupted or error-free, be compatible with other systems, or be free from viruses or other harmful components. You are responsible for implementing appropriate safeguards, including the use of antivirus protection and secure systems when accessing the Platform.
Limitation of Liability
To the fullest extent permitted by applicable law, the Foundation shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to loss of profits, loss of data, business interruption, reputational harm, or other intangible losses arising out of or in connection with:
- Your access to or use of, or inability to access or use, the Service;
- Any errors, inaccuracies, interruptions, delays, or technical failures of the Service;
- Unauthorized access, hacking, or alteration of Your data or Account;
- Any dispute between You and any third party;
- Your own negligence or misuse of the Platform;
- Payments made outside the methods officially provided by the Foundation.
Notwithstanding anything to the contrary in these Terms, the total aggregate liability of the Foundation arising out of or relating to the Service shall be limited to the total amount actually paid by You through the Service within the relevant transaction, or USD 100 if no payment has been made.
Applicable Law Limitation
Nothing in these Terms excludes or limits liability to the extent such exclusion or limitation is prohibited by applicable law. In jurisdictions where certain warranties or limitations of liability are not permitted, the Foundation’s liability shall be limited to the maximum extent permitted by law.
Indemnification
If there is a dispute between You and another user or third party, You hereby agree to release the foundation, including the foundation’s Affiliates, from any claims and demands for damages and losses (actual and implied).
You hereby agree to indemnify the foundation and keep the foundation, including its Affiliates, indemnified from any claims or demands, including reasonable legal fees, made by a third party arising directly or indirectly from Your breach of these Terms and Conditions, improper use of the Platform, and/or violation of applicable laws in the Country or violation of the rights of third parties by You.
Governing Law
These Terms and Conditions are governed by and construed in accordance with the laws of the Republic of Indonesia, without regard to conflict of law provisions.
These provisions do not override the application of mandatory laws, including consumer protection laws, that apply to you under the laws of your country of residence.
Disputes Resolution
If You have any concern or dispute about the Service, You agree to first try to resolve the dispute informally by contacting the foundation to be carried out by deliberation and consensus within a period of 30 (thirty) working days from the date the dispute is notified to the foundation.
Before contacting the foundation directly for negotiation to resolve the issue or dispute, You agree not to publicly announce, make social media posts, or print materials related to the issue that may directly or indirectly harm the foundation.
If an agreement is not reached through amicable negotiation within the 30 (thirty) working days, then legal action can be taken to the Semarang District Court.
During the dispute resolution process, You are required to continue to comply with and fulfil Your obligations according to these Terms and Conditions.
Force Majeure
The Foundation shall not be liable for any delay or failure to perform its obligations due to events beyond its reasonable control, including but not limited to natural disasters, war, government actions, pandemics, infrastructure failures, cyber-attacks, or third-party service disruptions.
Obligations affected by force majeure are suspended for the duration of the event. Payment obligations due prior to such event remain payable.
Severability and Waiver
If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force and effect.
Except as provided herein, the failure to exercise a right or to require performance of an obligation under this Terms shall not affect a party’s ability to exercise such right or require such performance at any time thereafter nor shall be the waiver of a breach constitute a waiver of any subsequent breach.
Translation Interpretation
These Terms and Conditions may have been translated if We have made them available to You on Our Service. You agree that the original English text shall prevail in the case of a dispute.
Changes to These Terms and Conditions
We reserve the right, at Our sole discretion, to modify or replace these Terms at any time. If a revision is material, We will make reasonable efforts to provide at least 30 days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at Our sole discretion. By continuing to access or use Our Service after those revisions become effective, You agree to be bound by the revised terms. If You do not agree to the new terms, in whole or in part, please stop using the website and the Service.
